1. Acceptance of Terms

By accessing or using Kwachafin ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Description of Service

Kwachafin is a village banking platform that enables users to:

• Create and join savings groups
• Make contributions to group funds
• Request and manage loans from group funds
• Track financial transactions and balances
• Communicate with group members

3. User Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

4. Account Registration and Security

4.1 Account Creation

You must create an account to use the Platform. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password
• Not share your account credentials with others
• Notify us immediately of any unauthorized access
• Log out after each session

5. Financial Transactions

5.1 Contributions

When you make contributions to a group, you authorize us to deduct the specified amount from your account balance. All contributions are final and non-refundable except as required by law.

5.2 Loans

Loans are subject to group approval and terms. By requesting a loan, you agree to:

• Repay the loan according to the agreed schedule
• Pay any applicable interest as determined by the group
• Accept that failure to repay may result in restrictions on your account

5.3 Subscription Fees

A monthly subscription fee is required for each group you join. This fee helps maintain the Platform and is non-refundable. You authorize us to automatically deduct subscription fees from your account balance.

5.4 Transaction Limits

You cannot transfer or withdraw more than your available account balance. All transactions are subject to verification and may be delayed or rejected for security reasons.

6. Group Participation

6.1 Group Rules

Each group may have its own rules and requirements. By joining a group, you agree to abide by those rules in addition to these Terms.

6.2 Group Administration

Group administrators have the authority to approve or reject loan requests, manage members, and enforce group rules. We are not responsible for decisions made by group administrators.

7. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform's operation
• Impersonate any person or entity
• Engage in fraudulent activities or money laundering
• Harass, threaten, or abuse other users
• Upload malicious code or viruses
• Scrape or collect data from the Platform without permission

8. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Kwachafin or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The Platform is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service.

9.2 Financial Advice

We do not provide financial, investment, or legal advice. Any information on the Platform is for informational purposes only.

9.3 Limitation of Liability

To the maximum extent permitted by law, Kwachafin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Indemnification

You agree to indemnify and hold harmless Kwachafin, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason. Upon termination, you remain liable for any outstanding obligations, including loan repayments.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the laws of Zambia, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Zambia, without regard to its conflict of law provisions.
